Intellectual Property Law: Protecting Your Creative Works

You created it. You love it. Now, how do you stop someone else from stealing it? Welcome to the wild west of Intellectual Property (IP) law, where ideas are currency and lawyers are the sheriffs.

The Holy Trinity of IP

Not all protection is created equal. Before you slap a "©" on your invention or try to patent your poem, know the difference. Here’s a cheat sheet for the aspiring genius:

Type What it Protects Duration
Copyright Creative works (Books, Code, Art) Life + 70 Years
Trademark Brand names, logos, slogans Indefinite (if renewed)
Patent Inventions and processes 20 Years

Table 1: Pick your weapon. Know your rights.

  • Copyright (Autoriõigus): Automatic protection for creative works. Books, code, selfies. It lasts your entire life + 70 years. That’s a legacy!
  • Trademark (Kaubamärk): Protects your brand identity. Logos, slogans, names. Think "Coca-Cola" or the Nike swoosh. If you don't use it, you lose it.
  • Patent (Patents): For inventions. It’s a deal with the government: you tell everyone how it works, and they give you a 20-year monopoly. Expensive, but powerful.

Defend Your Art!

In the digital age, copy-pasting is easier than breathing. But just because you can right-click > save as, doesn't mean you should.

Common Myths Debunked

  • "I mailed it to myself, so it's copyrighted." - False. Poor man's copyright is a myth.
  • "I changed it by 10%, so it's new." - False. That's called a derivative work (and potentially infringement).
  • "There was no copyright symbol." - Irrelevant. Protection is automatic.

"Good artists copy, great artists steal."

Pablo Picasso (who probably wouldn't say that in court today)
